Welcome to Bulkify, operated by Indo Bulkify Trade Pvt. Ltd., registered under the Companies Act, 2013, having its registered office at Plot No. 143, 123/27, Gadarian Purwa, Udyog Nagar, Ratan Lal Nagar, Kanpur Nagar, Uttar Pradesh – 208022 (“Company”, “we”, “our”, or “us”).
These Terms of Service (“Terms”) govern your use of the BulkifyB2B.com website (“Website”) and the Bulkify mobile application (“App”) (collectively, the “Platform”). By accessing or using our Platform, you agree to be bound by these Terms. If you do not agree, you may not access or use our services.
1. Eligibility
By using the Platform, you confirm that:
● You are at least 18 years old; and
● You have the legal capacity to enter into a binding agreement; and
● You are accessing the Platform for lawful purposes, either as an individual consumer or a business entity.
2. Services
Bulkify provides an online marketplace and ordering platform for food, beverage, and HoReCa supply products, available for bulk and retail purchases. We supply through our own inventory.
3. Account Registration
● To place an order, you may need to register an account with accurate and complete details.
● You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account.
● We reserve the right to suspend or terminate your account if any information is found to be false, misleading, or fraudulent.
4. Orders and Payments
● Orders may be placed through the Platform using available payment methods (UPI, Credit/Debit Card, Net Banking, etc.).
● Once an order is confirmed, you will receive a confirmation message via email or SMS.
● Prices displayed are inclusive/exclusive of taxes as mentioned on the Platform.
● We reserve the right to modify or discontinue products or prices without prior notice.
5. Cancellations and Refunds
● You may cancel an order within one (1) hour of placing it by using the “Cancel Order” option in the app or contacting customer support.
● Refunds for cancelled orders will be processed to the original payment method within 7–10 business days.
● Orders already dispatched are not eligible for cancellation.
● If a product is damaged, defective, or missing, please report it within 24 hours of delivery with photos/videos for verification.
6. Delivery and Shipping
● Deliveries are managed by Bulkify and/or third-party logistics partners.
● Delivery timelines are estimates and may vary based on location and availability.
● Risk of loss and title for products pass to you upon delivery.
● In case of delivery issues (delays, wrong items, etc.), please contact customer support for assistance.
7. User Conduct
You agree not to:
Violation of these conditions may result in suspension or termination of your account.● Use the Platform for any unlawful purpose.
● Attempt to gain unauthorized access to our servers or data.
● Use automated tools, bots, or scripts to interact with the Platform.
● Post or transmit any misleading, defamatory, or harmful content.
8. Intellectual Property
All content on the Platform, including trademarks, logos, text, images, product designs, and software, are the property of Indo Bulkify Trade Pvt. Ltd. or its licensors. You may not reproduce, distribute, or exploit any part of the Platform without prior written permission.
9. Third-Party Services
Our Platform may include links or integrations with third-party websites, services, or logistics providers. We are not responsible for the content, accuracy, or practices of such third parties.
10. Limitation of Liability
To the maximum extent permitted by law:
● The Company shall not be liable for any indirect, incidental, or consequential damages, including loss of profits, data, goodwill, or other intangible losses, arising out of your use or inability to use the Platform.
● Our total liability, whether in contract or tort, shall not exceed the amount paid by you for the product(s) purchased.
11. Indemnification
You agree to indemnify and hold harmless Indo Bulkify Trade Pvt. Ltd., its directors, officers, employees, and affiliates from any claims, damages, or expenses arising from your use of the Platform, violation of these Terms, or infringement of any rights of others.
12. Privacy
Your use of the Platform is also governed by our Privacy Policy, available at https://www.bulkifyb2b.com/privacypolicy.
13. Dispute Resolution and Governing Law
● These Terms shall be governed by and construed in accordance with the laws of India, without regard to conflict of law principles.
● Any dispute arising from these Terms shall be subject to exclusive jurisdiction of the courts at Kanpur, Uttar Pradesh.
● Parties shall attempt to resolve disputes through amicable negotiation or arbitration before approaching the courts.
14. Termination
We may suspend or terminate your account at any time for violation of these Terms or for any other reason deemed appropriate by the Company. Upon termination, your right to use the Platform will cease immediately.
15. Changes to Terms
We may update or revise these Terms periodically. Continued use of the Platform after such updates constitutes acceptance of the revised Terms.
